Upheal’s platform is HIPAA compliant, and use of the platform should not increase the likelihood that records could be made available in a lawsuit. Each state has its own rules regarding therapist-client privilege in lawsuits. Upheal is home to a wide spectrum of healing professionals, and depending on what license you hold, those rules may or may not apply to you, and you should consult a local attorney regarding privilege rules in your state. Nothing in this section shall be considered legal advice from Upheal to any therapist, individual, or entity.

Upheal operates as a “Business Associate” under HIPAA, and when joining the platform you agreed to the Business Associate Agreement. This agreement affirms Upheal’s requirement and commitment to not disclose sensitive information, including transcripts. Upheal knows that client confidentiality is an essential component of the relationship between the client and the healing professional, and ensures that the platform adheres to the highest standards of confidentiality.
